This supplement applies if you are located in the United States or Canada. It sits alongside, and does not replace, our main Website & Marketing Privacy Notice.

1. United States — your state privacy rights

A number of US states have their own comprehensive privacy laws. If you are a resident of a state with such a law, you may have the right to:

  • Know what personal data we hold about you and how we use it
  • Access a copy of your personal data
  • Correct inaccurate personal data
  • Delete your personal data, subject to certain exceptions
  • Opt out of the sale or sharing of your personal data, and of processing for targeted advertising
  • Appeal a decision if we decline to act on your request
  • Not be discriminated against for exercising these rights

2. Canada — PIPEDA

For individuals in Canada, our processing of personal data is governed by the Personal Information Protection and Electronic Documents Act (PIPEDA), which requires us to collect, use and disclose personal data only for purposes a reasonable person would consider appropriate, to obtain meaningful consent, and to allow individuals to access and correct their data.

3. Canada — electronic marketing (CASL)

Canada’s Anti-Spam Legislation (CASL) requires that commercial electronic messages, including marketing emails, are sent only with the recipient’s express or implied consent, clearly identify who is sending the message and how to contact us, and include a working unsubscribe mechanism in every message. Implied consent under CASL is narrower and shorter in duration than the PECR soft opt-in used in the UK, so contacts in Canada should be checked against CASL’s specific consent rules as part of the lawful basis mapping exercise, not assumed to be covered by the same rules as UK/EU contacts.
